Catch Labs LLC, including affiliates (collectively, “Catch”, “we”, or “us”) is committed to respecting your privacy. This Privacy Policy will help you better understand how we collect, use, and share your personal information when you use our website (www.catchbio.com, our “Site”), the Catch platform (our “Platform”), and related products or services (together, our “Services”).

Please review this Privacy Policy very carefully. Our Terms, linked here, incorporate this Privacy Policy by reference in its entirety. Capitalized terms set forth in the Terms, and their respective definitions, apply equally to this Privacy Policy.  By agreeing to our Terms, you accept all terms and conditions of this Privacy Policy, to the fullest extent permitted by applicable law. 

WHAT PERSONAL INFORMATION DO WE COLLECT ABOUT YOU?

We collect personal information about you when you create a Catch account, use our Services, update your profile, or otherwise interact with Catch. We may collect the following categories of personal information from or about you:

  • Identifiers, such as your name, home and work address, phone number, email address, username and password, and IP address.
  • Health information, such as your wellness background, weight, height, lifestyle, medical history, medical condition, genetic information, biometric information, healthcare providers, your reason for visiting a healthcare provider, date of visit, images or videos, diagnoses, treatment plans, laboratory results, payment data, insurance information, claims data, and information about your health and/or disability status, including pregnancy information.
  • Demographic information, such as age, date of birth, sex, gender, national origin, citizenship, race, marital status, family composition, sexual orientation, geographic information, education, and employment.
  • Usage information, such as information about your usage of the Platform or the Services.
  • Device and electronic network activity information, including information from devices you use to connect to our Services, such as your mobile device. The information we receive from these devices may include browsing IP address, physical location including Global Position System (“GPS”) data, unique device identifiers such as MAC address, usage information, crash data, device performance characteristics and hardware information, battery status, WiFi network information, browsing history, search history, clickstream patterns, session information, browser and operating system type, navigation paths, date/time stamps, cookie identifiers, language preferences, profile or user information associated with your social media account, and other information about how you interact with our Site.
  • Transaction information, such as claims information, information about payment methods, and related financial information.
  • Information you submit to us via the Service while utilizing our Platform or communicating with us.

Some of the information that we collect may be considered sensitive personal information in some states, such as certain health and demographic information.

In general, we process your personal information as a “data controller” or a “business” under applicable privacy laws, meaning that we determine how to process and protect your personal information.

HOW DO WE COLLECT YOUR PERSONAL INFORMATION?

We collect personal information directly from you, and from other sources. Depending on how you use our Services, we may collect information via the following means:

  • Directly from you. We may collect personal information directly from you through your use of our Services, completion of registration, feedback, or offboarding forms, account creation, communications with Catch, content that you post on the Services, or your engagement on social media platforms.
  • Directly from your device. We may collect personal information directly from your device using automated technologies as described in the Cookies and Similar Technologies section below. For example, when you access our Site we automatically collect your device IP (Internet protocol) address and other information about your device including your browser type, operating system, and information about cookies that may be located on your device.

HOW DO WE USE YOUR PERSONAL INFORMATION?

We may use your personal information for the following purposes:

  • Provide our Services. We may use your personal information to provide our Services, provide health recommendations, process payments, support care coordination, and respond to your questions and comments.
  • Communicate with you. We may use your personal information to send you marketing and other information about our Services, send you educational materials, and obtain and respond to your feedback, questions, and comments.
  • Improve our Services. We may use your personal information to improve our Services, perform market research and analysis, assess how our Services are being used, and develop new Services.
  • Secure our Services and systems. We may use your personal information to maintain the security and integrity of our Services, detect potential security vulnerabilities and incidents, protect our Services against fraudulent and illegal activity, and enforce our Terms of Use.
  • For research and development. We may de-identify, pseudonymize, or anonymize your personal information by removing certain identifiable data points (such as your name, email address, or linkable tracking ID) that makes the data personally identifiable to you or through other means. We do this so that, where permitted by law, we can conduct research and further develop our products and Services. This also includes without limitation for sale to market research firms, advertisers, healthcare systems and providers, medical practices, governmental institutions, universities, and research firms, as well as for research and development pertinent to healthcare, wellness, medical technology, and related services, products, and offerings.
  • Comply with legal obligations. We may use your personal information to comply with our legal obligations, including maintaining records of our compliance with international, federal, and state law requirements, and responding to court orders or subpoenas. Absent exigent circumstances, we will only provide your personal information in response to a third party subpoena if it is issued by a court with jurisdiction to compel us to produce your personal information, and we believe we are legally bound to do so. We may also use your personal information for other purposes consistent with the context of the collection of your personal information, for internal business purposes (for example when evaluating investments or investors), for additional purposes disclosed to you at the time your personal information is collected, or with your consent.

COOKIES AND SIMILAR TECHNOLOGIES

We use cookies, pixels, and similar tracking technologies to help us understand how you interact with our Services and to keep our Services secure. These technologies operate by sharing certain information about you and your usage of our Services with our third party service providers.

We also use tracking technologies on certain portions of our Sites, which offer a range of content about our Services intended for current or prospective business customers who offer or may be interested in learning about offering our Services to their employees or members. These technologies are used to provide advertisements that may be relevant to you and may also share data with third parties (including social media and AdTech companies) to help us track conversions, build custom audiences, and tailor our marketing campaigns. We do not use these tracking technologies when you are logged into our Platform. When you use our Sites and do not opt out of these tracking technologies, the privacy policies of the tracking technology providers will apply. Some examples of these types of tracking technologies include:

  • Google Analytics. We use Google Analytics to track activity on our Sites, such as session duration and pages per session, along with the information about the device being used to access our Sites. 
  • Amplitude. We use Amplitude to track activity on our Sites, such as session duration and pages per session, along with the information about the device being used to access our Sites.
  • Facebook Pixel. We use the Facebook Pixel to market our Services, optimize our marketing strategies, assess the effectiveness of our marketing efforts, and reach additional business customers who may want to offer our Services to their employees.

We may update this Privacy Policy from time to time. The most recent version of the Privacy Policy is reflected by the version date located at the top of this Privacy Policy. We encourage you to review this Privacy Policy often to stay informed of how we may process your information. If we have the ability to do so (e.g., if you have an active account, or we have contact information for you), we will attempt to notify you of any material changes to our Privacy Policy that impact your personal information. If you object to any changes to the Privacy Policy, you may request to close your account.

  • Our service providers. We may share your personal information with service providers that we use to help us operate our business, including: maintaining, operating, hosting, and improving our Services; payment processing; communicating with customers or business partners; data analytics; and marketing and advertising. We try to limit our service providers’ use of your information to that which may be necessary to perform their services for us.
  • Other service providers. If you choose to engage with a service provider offering their services via our Platform, such as healthcare providers or care coordinators, we may share your personal information with them so that they may provide their services to you.

Additionally, we may share your personal information: (i) in the event of a bankruptcy, merger, acquisition, sale of all or part of our business, or other change or ownership or control (whether in whole or in part), subject to compliance with applicable legal requirements; (ii) when legally required in response to a binding and enforceable legal request, subpoena, court order, or similar legal instrument; and (iii) in order to protect our Services from security threats or unlawful or abusive conduct. Finally, we may share certain deidentified, aggregated, and statistical information with our business partners.

WHAT CONTROL DO YOU HAVE OVER YOUR PERSONAL INFORMATION?

We believe you should be able to access and control your personal information no matter where you live. Depending on where you live and how you use our Services, you may be able to request access to, correct, amend, delete, or restrict certain uses of your personal information. We will not charge you more or provide you with a different level of service if you make any of these requests. Please note that certain types of requests may be limited in certain circumstances, and all types of requests may be limited by law or our legal obligations to others.

Finally, because there is no common understanding about what a “Do Not Track” signal is supposed to mean, we don’t respond to those signals in any particular way.

HOW DO WE PROTECT YOUR PERSONAL INFORMATION?

We implement and maintain appropriate and reasonable technical, physical, administrative, managerial, and organizational security measures designed to safeguard your personal information. Please note, however, we cannot fully eliminate security risks associated with the storage and transmission of personal information. You also must keep your password secure and your account confidential. If you have reason to believe that the security of your account has been compromised, please notify us immediately at support@catchbio.com.

UNSUBSCRIBING FROM MARKETING

If you would like to stop receiving newsletters or other marketing or promotional messages, notifications, or updates, you may do so by following the unsubscribe instructions that appear in these e-mail communications. Please be advised that you may not be able to opt-out of receiving certain service or transactional messages from us, including legal notices.

CHILDREN’S PRIVACY

Our Services are not directed at or intended for use by minors. By signing up for the Catch platform, you confirm you are 18 years of age or older. 

LINKS TO OTHER SITES

Our Services may link to content from another website, application, or service. Please note that we have no control over and are not responsible for these external sites, their content, or any goods or services available through them. This Privacy Policy does not apply to those external sites, and we encourage you to review their independent privacy statements.

HOW LONG DO WE KEEP YOUR INFORMATION?

We will keep your personal information only for as long as necessary to fulfill the purposes for which we have collected it. To determine the appropriate retention period, we consider the amount, nature and sensitivity of your personal data, the nature of our relationship with you, the potential risk of harm from unauthorized use or disclosure of your personal data, the purposes for which we process your personal data and whether we can achieve those purposes through other means, and any applicable legal requirements. We will also retain and use your personal information to the extent necessary to comply with our legal and contractual obligations, resolve disputes, and enforce our policies.

Additionally, once per calendar year you can request the types of personal information that we share with third parties for those third parties' direct marketing purposes, and the identities of the third parties with whom we have shared such information during the preceding year.
